Acceptance of Terms
By accessing or using DEEPdormir.pro ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms apply to all visitors, patients, providers, and any other users of the Platform.
If you are using the Platform on behalf of an organization (such as a medical practice), you represent that you have authority to bind that organization to these Terms.
We reserve the right to update these Terms at any time. Material changes will be communicated via email and homepage notice at least 14 days before taking effect. Continued use after changes constitutes acceptance.
Permitted Platform Use
DEEPdormir.pro is a healthcare provider directory and appointment-facilitation service. The Platform may be used only for lawful purposes and in accordance with these Terms.
You agree NOT to:
- Use the Platform in any way that violates applicable federal, state, local, or international law or regulation.
- Submit false, misleading, or fraudulent information including fake reviews, false credentials, or fabricated patient experiences.
- Attempt to gain unauthorized access to any part of the Platform, other user accounts, or our infrastructure.
- Use automated tools (bots, scrapers, crawlers) to extract data from the Platform without prior written consent.
- Transmit any advertising or promotional material without our express written consent.
- Impersonate any provider, patient, DEEPdormir employee, or any other person or entity.
- Interfere with or disrupt the integrity or performance of the Platform or its associated data.
- Harass, threaten, or defame any provider, patient, or staff member through any Platform feature.
Patient-Specific Terms
- Appointment Requests: Submitting an appointment request through our Platform does not guarantee an appointment. Scheduling is completed directly with the provider's office.
- Accuracy of Information: You are responsible for providing accurate contact information when submitting appointment requests or insurance verification inquiries.
- Review Eligibility: Only patients who have completed a verified appointment booked through DEEPdormir.pro are eligible to submit a Verified Review. Fabricating reviews is a violation of these Terms and may result in account suspension.
- No Doctor-Patient Relationship: Use of the Platform does not create a doctor-patient relationship between you and any listed provider or with DEEPdormir.pro.
- Emergency Situations: DEEPdormir.pro is not an emergency service. If you are experiencing a medical emergency, call 911 immediately.
Provider-Specific Terms
Healthcare providers and practices listed on DEEPdormir.pro ("Providers") agree to the following additional terms:
- Accuracy of Profile: Providers are responsible for ensuring that all profile information — including credentials, specialties, accepted insurance, office hours, and contact details — is accurate and kept up to date.
- Credential Verification: DEEPdormir.pro may independently verify credentials including NPI numbers, board certifications, and state licenses. Misrepresentation of credentials may result in immediate removal and potential reporting to relevant licensing authorities.
- Timely Response: Providers agree to respond to appointment requests submitted through the Platform within 2 business days.
- Compliance: Providers must comply with all applicable healthcare laws and regulations including HIPAA, state medical practice acts, and dental practice acts.
- Subscription Terms: Access to premium directory features is governed by the Provider Subscription Agreement, which supplements these Terms. See our Pricing page for details.
- Removal Rights: DEEPdormir.pro reserves the right to remove any provider listing at any time for violations of these Terms, patient safety concerns, unresolved complaints, or at our sole discretion with 30 days' written notice except in cases of immediate safety risk.
- Review Responses: Providers may respond to patient reviews through the provider portal. Responses must be professional, HIPAA-compliant, and must not disclose patient information without explicit written consent.
Accounts & Access
Provider portal accounts are required to manage your DEEPdormir.pro listing. The following rules apply to all accounts:
- Registration: You must provide accurate, current, and complete information when creating an account and keep it updated at all times.
- One Account Per Practice: Each practice location may maintain one primary account. Individual practitioners within a practice may have sub-accounts under the practice's primary account.
- Password Security: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@deepdormir.pro if you suspect unauthorized access.
- Account Responsibility: You are responsible for all activity that occurs under your account, whether or not you authorized it.
- No Transfer: Accounts may not be transferred, sold, or assigned to another party without our prior written consent.
- Inactive Accounts: Accounts showing no activity for 12 consecutive months may be deactivated. We will provide 30 days' notice before deactivation.
User Content & Reviews
DEEPdormir.pro allows patients to submit verified reviews and providers to submit profile content. The following rules govern all user-submitted content:
6.1 Content Standards
- All content must be truthful, accurate, and based on genuine first-hand experience.
- Content must not be defamatory, harassing, threatening, obscene, or unlawful.
- Content must not infringe on any third party's intellectual property, privacy, or other rights.
- Promotional content or advertising disguised as patient reviews is strictly prohibited.
- Content must not contain personal identifying information about third parties without their consent.
6.2 License Grant
By submitting content to DEEPdormir.pro, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, and distribute your content in connection with operating and promoting the Platform. You retain ownership of your content but waive any moral rights claims against us for such use.
6.3 Content Moderation
We reserve the right — but are not obligated — to review, edit, or remove any user-submitted content that we determine, in our sole discretion, violates these Terms or our community standards. We are not liable for any content posted by users.
Intellectual Property
The DEEPdormir.pro Platform and its original content — excluding user-submitted content — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of DEEPdormir and are protected by United States and international copyright, trademark, and other intellectual property laws.
- Trademarks: DEEPdormir, DEEPdormir.pro, and associated logos are trademarks of DEEPdormir. You may not use these marks without our prior written consent.
- Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purpose in accordance with these Terms.
- Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Platform or its content, nor may you reverse engineer or attempt to extract source code from any of our software.
- DMCA: If you believe your copyrighted work has been infringed on our Platform, contact us at support@deepdormir.pro with a detailed DMCA takedown notice.
Medical Disclaimers
- No Medical Advice: Information on the Platform is for general informational purposes only. Always seek the advice of a qualified healthcare provider regarding any medical condition or treatment.
- Provider Independence: Listed providers are independent practitioners and are not employees, agents, or representatives of DEEPdormir.pro. We do not control, supervise, or guarantee the quality of care provided by any listed provider.
- No Endorsement: Inclusion in the DEEPdormir.pro directory does not constitute our endorsement of any provider's medical skills, quality of service, or fitness to practice.
- Provider Credentials: While we verify certain provider information, we cannot guarantee the ongoing accuracy of all credential information. Always independently verify a provider's credentials before making medical decisions.
- Emergencies: If you are experiencing a medical emergency, call 911 immediately. Do not use DEEPdormir.pro in an emergency situation.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEEPDORMIR.PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or goodwill.
- Any damages resulting from your use of or inability to use the Platform.
- Any damages resulting from the conduct of any provider listed on the Platform.
- Any damages arising from unauthorized access to or use of our servers or your personal information.
- Any damages resulting from errors, omissions, interruptions, or delays in the Platform's operation.
IN NO EVENT SHALL DEEPDORMIR.PRO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DEEPDORMIR.PRO IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow exclusion of implied warranties or limitations on applicable statutory rights, so some of the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless DEEPdormir.pro, its parent company, affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service.
- Your use of the Platform in any manner not authorized by these Terms.
- Any content you submit, post, or transmit through the Platform.
- Your violation of any third-party right, including privacy, intellectual property, or other proprietary rights.
- Your violation of any applicable law or regulation.
Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms.
- Effect of Termination: Upon termination, your right to use the Platform immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.
- Provider Account Termination: Providers wishing to remove their listing must submit a written request to support@deepdormir.pro. Listing removal will be completed within 10 business days. Subscription fees paid are non-refundable unless otherwise specified in the Subscription Agreement.
- Patient Data on Termination: Upon account closure, your personal data will be handled in accordance with our Privacy Policy and applicable data retention requirements.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
- Jurisdiction: Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Nassau County, New York.
- Informal Resolution: Before initiating formal legal proceedings, you agree to first contact us at support@deepdormir.pro and attempt to resolve the dispute informally for at least 30 days.
- Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
- Time Limitation: Any claim arising out of or related to these Terms must be brought within one (1) year after the cause of action arose, or such claim is permanently barred.
